We are currently seeking an experienced individual to join this team in the role of Legal Counsel, Trusts and Private Banking


Role purpose – high level summary:
·
Provide legal advice and support on a broad range of technical legal issues relating to or arising out of the Private Wealth Solutions business in CIIOM (“PWS CI”), a division of Global Private Banking, including matters that may be complex or may have material impact.

·
To be considered as a trusted adviser to the PWS CI business by ensuring that commercially sensitive, pragmatic and practical legal support and advice is provided in a cost-effective manner to the PWS CI business.

Provide support and guidance to more senior lawyers and General Counsel in the CIIOM Legal Team assisting in identification of legal risks in the PWS CI business and appropriate risk mitigation strategies to ensure that the PWS CI business remains compliant with legal risk management requirements set out in the Group Standards Manual and Legal FIM and the interests of the HSBC Group are adequately protected.

Provide support to PWS and CIIOM governance meetings where legal representation is required.

Manage the appointment and supervision of external legal counsel where required by the business for specialist legal advice.

Accountabilities for Business, Customers and Stakeholders

Business

Provide legal support within the assigned area of responsibility and on a variety of legal matters including matters that may be complex or have potential for significant impact.

·
To be considered a trusted adviser to the business by ensuring that commercially sensitive, pragmatic and practical legal support and advice is provided in a cost-effective manner to the PWS CI business.

·
Support the General Counsel, CIIOM in implementing legal policies to ensure that the Group's exposure to Global legal risks is managed appropriately within the PWS CI business.

Customers/Stakeholders

·
Provide specialised legal and related regulatory advice, guidance and support to the PWS CI business, in conjunction with other second line risk stewards.

·
Manage the provision of prompt, commercial, practical and often complex and/or specialised legal advice to the PWS CI business.

·
Be proactive in the provision of legal support and in advising the PWS CI business promptly of key legal and regulatory developments impacting the PWS CI business and to advise the business accordingly to ensure ongoing compliance.

·
Assist in managing the relationships with panel law firms/external legal counsel.

Leadership & Teamwork
·
Maintain and develop positive and professional working relationships with all members of the CIIOM Legal Team, other relevant legal teams (including the PWS Global Legal Team, GPB Legal Team and UK Legal Team) and members of PWS.

Share legal knowledge and best practices with legal colleagues.

·
Participate in the co-ordination and promotion of initiatives that result in the sharing of legal knowledge and best practices across the Global Legal Function.

Develop supportive relationships with other specialist advisory functions, including regulatory compliance and tax

Desired profile



Qualifications :

Required Functional Knowledge
· 
Qualified Solicitor, Barrister or Jersey Advocate with a developed specialisation in trusts law.

· 
Knowledge and experience of non-contentious Jersey trusts law and practice and private client work is essential. International trusts and private client work (in particular offshore experience in jurisdictions including Guernsey, the BVI and the Cayman Islands), as well as contentious experience, will also be beneficial given the geographical scope of the PWS business.

· 
Knowledge and experience of banking, finance and corporate law in the major jurisdictions in which PWS operates is also desirable.

· 
Ability to learn quickly and maintain knowledge about the HSBC Group business and personnel, HSBC Group policies and procedures, and develop a clear understanding of HSBC's corporate culture.

· 
Strong ability to deal with a number of stakeholders and to prioritise a demanding workload in terms of legal risk and commercial consideration.

· 
Communication and inter-personal skills with the ability to adapt communication style and content to appropriately address the management level of the audience.

· 
Lateral thinking/problem solving and the ability to understand the relationships between a range of complex issues and the impact of those issues from a legal, financial and reputational perspective to advise client and reach a solution.

· 
Ability to keep up-to-date with key legal and regulatory developments impacting the PWS CI business and to advise the business accordingly to ensure ongoing compliance.
